2. Definitions

For the purpose of these General Terms and Conditions (the “T&Cs”), the following expressions shall have the meanings set out below.

Balance: The portion of the Price remaining due after payment of the Deposit.

Booking: The formation of the Contract upon ESPEERIA’s receipt of the Deposit within the offer validity period set out in article 6.

Booking Offer: Document presenting the proposed Services, price and important information, to which are attached the Itinerary, T&Cs and the standard information form.

Booking Confirmation: Document recapitulating the Contract conditions sent to the Customer after payment to confirm payment receipt and Booking, to which are attached the Itinerary, the T&Cs and the standard information form.

Contract: The agreement entered into between ESPEERIA and the Customer regarding the Services, governed by the Contract Documents.

Contract Documents: The Booking Offer (once accepted), Booking Confirmation, attached Itinerary , the T&Cs and the attached standard information form. From Booking, the terms in these documents govern the Contract as set out in article 7.

Customer: (or « you ») any natural person entering into the Contract as defined herein with ESPEERIA, including participants in the case of Bookings made by one Customer for other participants (see article 6) and travelers who have booked ESPEERIA Services through a Distributor.

Deposit: The portion of the Price payable upon Booking.

Distributor: Any partner of ESPEERIA authorized to market the Services to travelers.

ESPEERIA: (or « us ») the company mentioned in article 1. 

Itinerary: Document detailing the stages of the Trip under the Contract.

Parties: ESPEERIA and the Customer.

Price: The total amount payable by the Customer under the Contract for the Services.

Service: Services provided by ESPEERIA under the Contract. Unless evidenced otherwise Booking Offer, ESPEERIA’s Services are tourist packages within the meaning of Article L. 211-1 of the French Tourism Code.

Trip: Organized travel under the Contract during which the Customer will benefit from the Services. 

Trip Countries: Countries visited or crossed during the Trip as specified in the Contract.

Trip End: End of the Services under the Contract.

Trip Start: Start of the Services under the Contract.

3. Purpose and scope

The purpose of these T&Cs is to define the rights and obligations of the Parties regarding the Services provided by ESPEERIA to Customers. They apply to the Services offered by ESPEERIA, whether marketed directly or through a Distributor, and to the Contract entered into by ESPEERIA and the Customer.

Any Booking implies unconditional acceptance of the Contract Documents which prevail over other conditions not stated in the Contract Documents. Any exception shall be mentioned in the Contract Documents or expressly accepted in written form by ESPEERIA (e.g. by an explicit e-mail from ESPEERIA).

4. Pre-contractual information

Prior to the Booking, ESPEERIA sends the Contract Documents, containing all relevant information on the Services and all the information listed in article R. 211-4 of the French Tourism Code. The customer acknowledges having received and fully understood them.

The Customer further acknowledges having received the form taken in application of the French Decree of March 1, 2018 “setting the model information form for the sale of trips and stays” and attached to the T&Cs communicated with the Booking Offer.

The Customer declares being in capacity of validly entering into the Contract, having read and understood the T&Cs before Booking and fully accepts them.

5. Participants to our Services, groups

Our Trips will typically attract young adults in their 20es or 30es, travelling without children, participants of different nationalities, solo travelers and/or small groups of friends or couples.

We strive through our Booking process (see article 6) to propose services that match your requirements and allow the constitution of groups that we believe have the best chances to work well and allow for a Trip in line with our offers and vision. As a result, we may suggest to you another trip than the one desired.

Furthermore, Services are subject to availability at the time the Deposit is received. Availability information (website or direct) may change. If a Service becomes unavailable between the Booking Offer and payment of the Deposit, we will inform you as soon as possible and propose reasonably equivalent alternatives or refund any payment received.

Please inform us before Booking of any special request or situation (meals, disabilities/reduced mobility, health conditions, assistance needs). Despite all our efforts, certain situations may result in additional costs or sometimes be incompatible with the Trip or some of the Services.

No pets: our trips currently do not allow animals. Please contact us for special situations (e.g. assistance animal).

6. Booking process 

The Customer contacts ESPEERIA by telephone, email, social media or via its Site by completing an information questionnaire with basic personal information and the desired services (your personal information is subject to our privacy policy, see article 28).

After an initial call to clarify your needs, ESPEERIA emails a Booking Offer with these T&Cs and other Contract Documents, which constitute an offer to enter into the Contract. 

The offer is valid for the period stated in the Booking Offer (10 days if not stated). To complete the Booking, the Customer must pay the initial Deposit indicated in the Contract Documents to accept the offer. The Contract is only formed when ESPEERIA receives the Deposit within that period. Payments received after expiry constitute a new offer from the Customer; the Contract then only forms upon ESPEERIA’s written acceptance expressed through a confirmation e-mail. 

Please contact ESPEERIA if you did not receive a confirmation e-mail within 3 days after your payment.

Booking for more than one Customer: Should the Booking be made by one Customer for other persons, the Customer in contact with ESPEERIA ensures that these other persons have had all information provided by ESPEERIA and have agreed to the terms of the Contract before Booking.

No right of Withdrawal: Because ESPEERIA’s Services constitute package travel, the statutory 14-day withdrawal right does not apply (French Consumer Code, L.221-2, 5°). This does not affect the Consumer’s contractual cancellation rights set out in article 18.

7. Contract documents

The Contract is governed by the terms of the Contract Documents. In the event of any inconsistency, the following order of precedence applies: (1) Booking Offer, Booking Confirmation, as well as attached Contract Documents specific to the Trip (Itinerary etc.) (2) these T&Cs.

Please note that the content on the ESPEERIA website or other communication medium is for information purposes and may not be up to date, which is why only the terms of the Contract are binding upon ESPEERIA.

8. Included Services 

The Services included in the Contract are imitatively listed in the Booking Offer, Information Form and Itinerary. Please therefore refer to such specific Contract Document. For information purposes only, our Trips generally include:

  • Accommodation;
  • Breakfast;
  • Local transportation;
  • Activities and related entrance fees, necessary equipment, guidance;
  • Tourist Taxes.

Unless otherwise stated in the Booking Offer, the Services do not include the following:

  • Travel to the Trip Start location and from the Trip End location, 
  • Personal travel insurance (covering flight delays/cancellations, lost luggage, medical expenses, etc.)
  • Any personal expenses, e.g. additional expenses in the accommodation (laundry and dry cleaning, mini bar charges, telephone calls, baggage charges etc.)
  • Lunch & Dinner, food & beverages not included in the Services.

9. Arrival / Departure

Travel to the Trip Start and from the Trip End is your responsibility. ESPEERIA is not liable for delays or cancellations affecting your personal travel arrangements and cannot refund Services missed as a result or be held liable for obstacles to your return after the Trip.

10. Specificities of our offers

ESPEERIA offers different categories of organized travels with following specific characteristics, subject to the more specific information in the Booking Offer.

Creators Travel Club: This offer consists in small-group travels led by a personality such as a creator, artist, or expert. The group size will generally be below 15 people. While we make our best efforts to maintain the participation of the announced personality, please note that a cancellation may happen for various reasons. In such case we will make our best efforts to find a suitable replacement. Should the replacement not satisfy the Customer, the Customer will have the option to cancel the trip and benefit from adjusted refund terms in application of article 16. Should we not be able to replace the group leader, the Customer will be given the choice to either maintain the Trip and benefit from a price reduction or cancel the trip and benefit from adjusted refund terms in application of article 17.

ESPEERIA Curation: This offer consists of customized trips, designed by ESPEERIA based on the Customers’ specific requirements. 

11. Travel insurance

We do not currently propose travel insurance and recommend that you check your current coverage (refer to your health insurance conditions, credit card insurance etc.) against the various risks of traveling (notably cancelation, repatriation, health risks etc.) in the Trip Countries and seek out additional protection if needed. 

The Customer undertakes to hold and be up to date with their civil liability insurance to cover any damage they may cause. 

12. Price

The prices indicated on ESPEERIA or the Distributor’s website or documentation may be revised before Booking. The Price proposed is indicated on the Booking Offer.

The Price is stated and payable in euros, all taxes included (TTC). It may be announced per person or globally in the case of groups. It is possibly calculated according to the number of participants. 

A conversion into another currency may be provided on ESPEERIA’s website or documents as an indicative estimation at the date of such document. ESPEERIA is in no way bound by such indication and is not liable for any costs incurred by conversion to euro or changes of the conversion rate.

The Price only includes the elements indicated in the Booking Offer and in the T&Cs (see article 8), unless otherwise agreed in written. 

Services not initially included in the Contract are charged additionally at the price agreed upon with ESPEERIA.

13. Payment terms

Unless otherwise stated in the Booking offer, the payment is split as follows:

  • Payment of a Deposit for Booking: 30% of the Price,
  • Payment of the Balance latest 45 days before the Trip Start: 70% of the Price, subject to adjustments in application of the Contract (refer to article 18 and 19 cancellation and refund conditions).

For Bookings made within 45 days of Trip Start, the Price is payable in full at Booking.

Payment shall be made through the means indicated in the Booking Offer. In general, we only accept following means of payment:

  • Payment service indicated in the Booking Offer (e.g. Stripe);
  • by credit/debit card (Carte Bleue, Visa card, Eurocard/Mastercard),
  • by bank transfer (transfer fees payable by the Customer),
  • By ESPEERIA voucher (subject to the conditions of use of such voucher and in these T&Cs).

The Customer guarantees to ESPEERIA that he has the authorizations that may be necessary to use the payment method chosen by him, when validating the contract. 

Payments made by the Customer will only be considered final after actual collection by ESPEERIA of the amounts due. 

As stated in article 13 failure to pay the Deposit results in the failure to book the Trip and ESPEERIA not being bound in any way.

After the Contract is validly formed, failure to comply with the payment terms gives ESPEERIA the right to: 

  • either suspend the Contract (thereby suspending the fulfillment of its obligations and the provision of any Services) until the failure is remedied by the Customer; 
  • or definitively cancel the Contract without prior notice, in which case the same cancellation conditions apply as if the Contract had been cancelled by the Customer (see article 18). 

14. Important information: administrative and health formalities

Each Customer ensures that he is in possession of all necessary administrative documents for the Trip (such as identity and travel documents, visas, authorization to leave the territory, health documents, etc.) as required by the countries to be visited and their country of origin.

The documents must be valid during the Trip and we recommend that they be valid under a reasonable period after the Trip (e.g. 1 month). 

Travel requirements vary depending on the destination as well as the Customer’s situation and country of origin. Customers shall make sure to consult their own countries’ official information and travel recommendations for the countries to be visited.

It is recommended to regularly consult the information disseminated by the competent authorities on the health risks of the country(ies) of your Trip and to follow the health recommendations and measures to combat these risks accessible on the websites.

Please ensure to make such verifications long enough in advance in order to complete necessary administrative steps. The Information given to you by ESPEERIA is subject to change until the Trip Start date. Customers are therefore advised to consult the official websites regularly.

We cannot be held liable for any failure to comply with these regulations and consequent impediments to travelling and benefitting from the Services. ESPEERIA is not required to verify the validity and conformity of travel documents, even if they have been provided by the Customer.

15. Conduct

By Booking an ESPEERIA Trip, you accept that your conduct during the Trip must comply with following rules and principles.

During the Trip you must at all times comply with applicable rules in the places visited, such as local laws and regulations, internal regulations of the places visited etc., as well as the instructions given by ESPEERIA staff, its partners, employees of the places visited and local authorities.

You must also observe the practical information given by ESPEERIA regarding for instance the schedule (e.g. call time), equipment/clothing, groups etc. You recognize that failure to respect such practical information may result in non-participation in the Services.

Your conduct during the Trip must at all times be that of a prudent and reasonable person. You must be respectful of other Customers, ESPEERIA staff or partners as well as persons encountered in general. We will in particular not tolerate any discrimination based on sex, gender, race or religion, offensive, violent or aggressive behaviour, harassment, refusal to follow instructions, interference with the proper performance of the Services and smooth and safe progression of the Trip.

The Customer is advised that the habits, living standards and practices at the destination may differ from those they are familiar with and is encouraged to inform themself about cultural differences and be mindful of them.

You are invited to ask ESPEERIA or our partner’s staff any question in this regard and inform us about any misconduct or inconvenience.

Misconduct as described in this clause may result in your exclusion from participating in all or any part of the Trip and Services, without reimbursement or indemnification, as well as refusal of future Trips or Services.

16. Contract Modification (other than to the Price) at ESPEERIA’s initiative

Minor modification: Regarding the terms of the Contract other than the Price, ESPEERIA may unilaterally modify such terms after Booking and before the Trip Start, without the Customer being able to object, provided that the modification is minor and that the Customer is informed as quickly as possible in a clear, comprehensible and apparent manner on a durable medium.

Examples of minor changes include: 

  • reordering stages or schedules to adapt to the circumstances (opening hours, access, transport conditions, meteorological conditions);
  • replacing accommodation, activities, transport or meals with similar options.

Modification of an essential element: If, prior to Trip Start, compliance with one of the essential elements of the contract is rendered impossible as a result of an external event imposed on ESPEERIA, or in the event of a price increase of more than 8%, ESPEERIA must notify the customer as soon as possible and inform them of the modifications and their repercussions on the Trip, if applicable, of the other service proposed, as well as its price, and the Customer’s option to either accept the modification or to terminate the Contract at no cost.

The customer must communicate their response within the specified time limit. If no response is received within this time limit, the customer will be deemed to have accepted the request for modification.

If the customer refuses the proposed modification and terminates the contract, ESPEERIA will reimburse them within 14 days.

When the modifications to the Contract or the replacement Service result in a decrease in the quality of the Trip or stay or its cost, the Customer is entitled to an adequate price reduction.

17. Contract modification at the Customer’s initiative, non-use of Services

Trips are generally not modifiable after Booking. On request, ESPEERIA will advise whether a modification is possible and any resulting costs.

The Customer is advised that modifications may result in additional costs, in particular:

  • the withdrawal of Services may not give rise to an adjustment of the Price or reimbursement;
  • any addition of a Service is deemed to result in an upward modification of the Price;
  • An exchange of Services - if possible - may give rise to the new Service being charged and the replaced Service not being reimbursed.

Requests to switch to another Trip are treated as a cancellation of the original Trip and a new Booking.

Failure to use the Services due to the Consumer (e.g. late arrival at Trip Start or appointment during the Trip, early departure from a Service or the Trip, decision not to use Services during the Trip) will not give rise to any reimbursement

18. Cancellation by the Customer

The Customer may terminate the Contract at any time before the start of the stay, subject to the fees and reimbursement conditions as detailed herein, without prejudice to the possible coverage by an optional insurance policy taken out by the Customer.

To cancel, email us at the above-mentioned address. Your cancellation is effective on the date we receive your email. Should you not receive an acknowledgement of receipt or a reply, please call ESPEERIA to make sure the e-mail was received. 

Unless otherwise stated in the Booking Offer, the cancellation fees and schedule are the following.

Cancellation before 45 days before Trip Start: The Deposit is deemed to cover for the cancellation costs incurred by ESPEERIA and will therefore be retained. If the Balance has already been paid it will be reimbursed to the Customer. 

Cancellation after 45 days before Trip Start: The Price is deemed to cover for the cancellation costs incurred by ESPEERIA and will therefore be retained. 

Exceptional and unavoidable circumstances at the destination: No termination fees will be due if the Contract is terminated by the Customer because of exceptional and unavoidable circumstances occurring at the destination or in the immediate vicinity of it and having significant consequences on the execution of the Contract. In this case, ESPEERIA will proceed to a full refund of the payments made, without however resulting in additional compensation. 

19. Cancellation by ESPEERIA

ESPEERIA may terminate the Contract at any time, before Trip Start, but may be liable for compensation as provided for below.

Reimbursement without additional compensation: ESPEERIA may terminate the Contract and reimburse the amounts paid by the Customer without being liable for any additional compensation in the following cases:

  • Minimum number of participants not reached: The number of participants registered for the Trip is less than the minimum number indicated in the Contract (see Booking Offer). In this case, ESPEERIA will notify the Customer by email of the termination of the contract within the time mentioned on the Booking Offer and at least 20 days before Trip Start. 
  • Exceptional and unavoidable circumstances: ESPEERIA is prevented from performing the Contract due to exceptional and unavoidable circumstances. In this case, ESPEERIA shall notify the Client by email or in writing of the termination of the contract as soon as possible before the start of the stay.

Reimbursement with additional compensation: In other situations of terminations by ESPEERIA, and should ESPEERIA and the Customer not be able to reach an amicable agreement on a replacement Trip, ESPEERIA will refund the Customer the full amount paid and will pay compensation at least equal to the penalty that the Customer would have had to pay if the cancellation had been made by the Customer (see article 18).

ESPEERIA shall pay the customer the amounts due as soon as possible and no later than 14 days after cancellation.

20. Assignment of the contract

The Customer may assign the Contract to an assignee, provided he informs ESPEERIA by any means allowing an acknowledgement of receipt to be obtained at least 7 days before the Trip Start.

The assignment is subject to administrative costs of 5% of the Price  per Customer and any additional costs caused by the assignment. Upon receipt of such demand, ESPEERIA will ask for any information and documents necessary and communicate any additional costs expected to be caused by the assignment.

The assigning Customer and the assignee are jointly and severally liable for payment of the Price and any additional costs that the assignment may generate.

21. Assistance, difficulties, non-performance

ESPEERIA - and its Distributor if applicable – are liable towards the Customer for the proper performance of the Services in accordance with article L. 211-16 of the French Tourism Code. 

ESPEERIA further has to provide appropriate assistance as soon as practicable considering the circumstances of the case. Such assistance includes providing useful information on health services, local authorities and consular assistance, as well as assisting the traveller in making long-distance communications and finding other travel services.

If you encounter any defect, lack of conformity, non-performance affecting a Service or any difficulty, please reach out to the assistance contact mentioned on the Booking Offer as soon as possible to report the issue and/or request assistance.

If this difficulty is caused intentionally by the Customer or by their negligence, ESPEERIA will be entitled to charge a reasonable price, which will not exceed the actual costs incurred.

22. Remedy 

When the Customer reports a non-performance or non-conformity, ESPEERIA will provide a remedy if a remedy is possible and does not entail disproportionate costs in relation to the significance of the non-compliance and the value of the relevant Service.

The Customer shall provide, immediately with his request if possible or as soon as possible after Trip End, to his/her notification relevant supporting evidence so that ESPEERIA can accurately assess the problem and react accordingly. 

We draw your attention to the fact that the longer you take to inform us of your claim and provide us with appropriate evidence, the more difficult it becomes to deal with it in your best interests. To facilitate the processing of your claim, please include your booking reference and all details regarding the difficulty (place, date, persons involved, photos, messages etc.).

23. Non-performance of an important part of the Services

If an important part of the Services may not be performed as provided by the Contract, ESPEERIA will propose appropriate replacement services at no extra cost to the Customer. The Customer may only refuse such other services if they are not comparable to what was provided for in the contract or if the price reduction granted is not appropriate.

24. Price reduction, damages

Should ESPEERIA not have been able to remedy a non-conformity to the Contract, the Customer is entitled to a price reduction and, in the event of a distinct damage not repaired by the price reduction, to damages subject to the terms of the Contract (see notably article 25).

25. Exoneration and limitation of liability

ESPEERIA is only liable to the Customer for Services which are part of the Contract. 

ESPEERIA may be exonerated from all or part of its liability by providing proof that the damage is attributable either to the Customer, or to a third party not involved in the provision of the Services, or to exceptional and unavoidable circumstances. Subject to applicable mandatory law, ESPEERIA shall for instance not be held liable in following situations, without this list being limitative: 

  • Failure to comply with the Contract, see notably the rules on Conduct in article 15
  • Failure to provide information to ESPEERIA as required by the Contract or other information relevant to the Customer’s security and participation in the Services;
  • Damages caused by another Customer;
  • Participation in activities/services not part of the Contract and not invoiced by ESPEERIA, including activities which may have been suggested by ESPEERIA or its partners but are not included in the Services, and activities/services booked directly with ESPEERIA’s partners and not invoiced by ESPEERIA;
  • Any activities or periods of time where the Customers are autonomous;
  • Force Majeure events as well as exceptional and unavoidable circumstances, which may be, without limitation: strike and demonstrations, meteorological events, natural catastrophes, interruption of means of communications, medical event, epidemics and pandemics, measures of local authorities.

In accordance with article L 211-17, IV of the French Tourism Code, the amount of any damages that ESPEERIA may be ordered to pay to the Customer for any reason whatsoever, will be limited to three times the total Price excluding tax of the Services, with the exception of personal injury and damage caused intentionally or through negligence.

26. Exceptional and unavoidable circumstances

In the event of exceptional and unavoidable circumstances affecting the Services, the Parties will inform each other as soon as possible of their occurrence, as well as their disappearance.

The parties will come together to examine the impact of the event and agree on the conditions under which the execution of the Contract will be continued. If the exceptional and unavoidable circumstance lasts longer than three months, these general conditions may be terminated by the injured party.

27. Professional liability Insurance 

ESPEERIA has taken out a professional civil liability insurance guaranteeing ESPEERIA against the financial consequences of its professional civil liability resulting from articles L. 211-16 and L. 211-17 of the French Tourism Code, with the insurer mentioned above.

28. Protection of personal data

Data collected: In the course of managing Bookings and Trips, ESPEERIA collects and processes the following categories of personal data relating to Customers:

  • Identification data (first name, last name, date of birth, nationality, copy of ID if required by destination regulations);
  • Contact data (postal address, email address, telephone number, social media account if applicable);
  • Booking and travel information (selected Services, preferences, special requirements, room allocations, dietary restrictions if provided);
  • Information necessary to ensure safety and compliance (insurance details, emergency contacts, health information strictly limited to what is required for the Trip).

Purpose pursued: Your data is processed for the following purposes:

  • Management of Bookings and performance of the Contract (performance of contract);
  • Compliance with legal and regulatory obligations (e.g., accounting, travel regulations);
  • Communication with service providers strictly as needed to deliver the Services (performance of contract);
  • Customer support and after-sales service (performance of contract, legitimate interest);
  • Commercial communication and marketing (only with your consent).

Recipients : Access to your data is restricted to:

  • ESPEERIA’s staff in charge of Bookings and customer service;
  • Partners and service providers involved in delivering the Services (e.g., accommodation, transport, activity providers) strictly to the extent necessary;
  • Subcontractors acting on ESPEERIA’s behalf (e.g., IT hosting, payment services), subject to contractual confidentiality and security obligations;
  • Public authorities where legally required.

Transfers outside the EU: If any data transfer takes place outside the European Union, ESPEERIA ensures appropriate safeguards in compliance with GDPR (e.g., adequacy decision, standard contractual clauses).

Data retention:

  • Data relating to your Booking is retained for the duration of the Contract and archived for a maximum of 5 years after the Trip End, unless a longer period is required for legal obligations or dispute resolution.
  • Marketing data is retained until you withdraw your consent or request erasure.

Security: ESPEERIA implements appropriate organizational and technical measures to protect personal data against unauthorized access, alteration, loss or disclosure. 

Your rights: 

In accordance with GDPR and French data protection law, you have the right to:

  • Access, rectify, modify or erase your data;
  • Restrict or object to its processing;
  • Receive a copy of your data in a portable format;

These rights can be exercised by writing an email to hello@espeeria.com, with proof of identity.

At any time, the Customer may file a complaint with the CNIL according to the terms indicated on its website (https://www.cnil/fr).

Modification of the clause: ESPEERIA may update this clause from time to time, for example to reflect regulatory changes. If so, you will be informed by email at least 15 days before the changes take effect.‍

Opposition to telephone canvassing: You have the option to register on the list of opposition to telephone canvassing on the following website: http://www.bloctel.gouv.fr/.

29. Complaints and dispute resolution

In the event of a complaint, we invite you to first send your written request with all relevant documents to ESPEERIA, in application of article 22.

Should the response provided by ESPEERIA to the Customer on his complaint be deemed insufficient or remains unanswered after 60 days, the Customer may resort to conventional mediation or to other alternative dispute resolution method. You may for instance contact:

30. Proof

It is expressly agreed that the data contained in ESPEERIA’s information systems have probative force regarding orders, requests, and any other element relating to the use of the Site. They may be validly produced, in particular in court, as a means of proof in the same way as any written document.

31. Applicable law and jurisdiction

These T&Cs and the Contract are subject to French law. In the event of a dispute, the courts of Paris shall have sole jurisdiction. This applies to both substantive and formal rules. 

The present clause is without prejudice to mandatory public policy rules applicable to the Customer which cannot be excluded by the present choice of law and jurisdiction.

32. Miscellaneous

If any term or provision of the Contract is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of the Contract or invalidate or render unenforceable such term or provision in any jurisdiction.

The terms of the Contract are solely for the benefit of the Parties and shall not create any rights nor be enforced by any person who is not a Party to the Contract.

The titles used in these T&Cs are for convenience only and do not have any contractual value. 

The Contract comprises the entire agreement between the Parties, and supersedes all prior or contemporaneous communications, both written and oral in relation to the subject matter of the Contract. It may only be modified as provided for in this Contract.

Standard information sheet for travel package contracts 

The combination of travel services proposed to you is considered a package in the sense of the EU directive 2015/2302 and of article L. 211-2 II of the French Code of Tourism.

You will therefore benefit from all the rights granted by the European Union applicable to packages, such as transcribed in the French Code of Tourism. 

ESPEERIA is wholly responsible for the proper execution of the package as a whole. 

In addition, as required by law, ESPEERIA is insured should they be required to refund your payments and, if transport is included in the package, to ensure your repatriation in the event that they should go bankrupt.

  • Travelers will receive all essential information about the package before concluding the package travel contract
  • The organiser and the retailer are liable for the proper performance of all the travel services included in the contract. 
  • Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the retailer.
  • Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
  • The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8 % of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.
  • Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate.
  • Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
  • Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
  • If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
  • Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
  • The organiser or the retailer has to provide assistance if the traveller is in difficulty.
  • If the organiser or the retailer becomes insolvent, payments will be refunded. If the organiser or the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured. ESPEERIA has taken out insolvency protection with Groupama ASSURANCE-CRÉDIT & CAUTION, 8-10 RUE D’ASTORG, 75008 PARIS, FRANCE.
